Terms of Service

Welcome to BeerCanTracker, operated by Kramer Software LLC ("Kramer Software", "we", "us", or "our"). By using beercantracker.com or the BeerCanTracker apps (together, the "Service"), you agree to these terms. If you do not agree, please do not use the Service.

What the Service is

BeerCanTracker is a reference database of vintage beer cans with photos, catalog identifiers, auction price history, current marketplace listings, and tools for tracking your own collection and wishlist.

Price data is informational only

Prices shown on the Service, including auction results, price statistics, estimates, and live marketplace listings, are collected from public sources and provided for informational purposes only. They are not appraisals, valuations, investment advice, or a guarantee of what any can is worth or will sell for. Sale prices depend on condition, grading, timing, and buyers, and our data may contain errors or gaps. Always do your own research before buying or selling.

Your account

You must provide accurate information when creating an account, and be at least 13 years old. Accounts are personal: keep your password confidential, do not share your credentials with or allow others to access the Service through your account, and do not use anyone else's account. Paid membership benefits apply only to the account that purchased them and cannot be shared or transferred. You are responsible for activity under your account. We may suspend or close accounts that violate these terms.

Content and data

All content and data on the Service, including the can database, price history, and the collections and wishlists maintained through your account, is the property of Kramer Software. The exception is content owned by others, such as marketplace listing content and USBC catalog images, which is credited to and remains the property of its respective owners.

By submitting or creating content on the Service, you assign it to Kramer Software and it becomes part of the Service. For can images you upload and can information you provide, this means they become a permanent, de-identified part of the Service's database, which we may use to power any feature of the Service. They are not publicly attributed to you, and because they are de-identified, they are not removed when your account is deleted or when you make a data deletion request: those requests remove your personal information and account data, while contributed images and can information remain in the database with no connection to you.

You are responsible for the content you submit. By submitting it, you represent that you own it or have the rights needed to submit it and to make the assignment above, and that it does not infringe anyone else's rights. We may remove content that we believe violates these terms or the law.

Your personal information remains subject to our Privacy Policy, including your right to request deletion, and we do not share your collection with other users without your action.

BCCA and USBC catalog data

The USBC catalog data and related images on the Service, including identifiers, references, and catalog details, are used under a license from the Brewery Collectibles Club of America (BCCA). When you use USBC data or images through the Service, you must also abide by the BCCA's terms of service for the USBC catalog, and you agree that the BCCA's terms govern your use of that data in addition to these terms. Your use of the Service does not grant you any right to use this data in any commercial capacity.

Third-party content and marketplaces

The Service displays content from third parties, including catalog images and current listings from marketplaces such as eBay. That content belongs to its respective owners. Listings link to third-party sites and sellers we do not control: any purchase, bid, or other transaction you enter into there is solely between you and that marketplace or seller, under their terms. BeerCanTracker is not a party to those transactions and has no responsibility for any part of them, including payment, shipping, item condition, authenticity, cancellations, refunds, or disputes. We are also not responsible for the accuracy or availability of third-party listings.

Some outbound links are affiliate links: when you click a link to a marketplace and make a purchase, BeerCanTracker may earn a commission. Our affiliate programs include, but are not limited to, the eBay Partner Network. This costs you nothing extra and does not affect which listings we show.

Memberships and payments

Parts of the Service may require a paid membership. Pricing, billing terms, and cancellation details will be presented before you subscribe. Except where required by law, payments are non-refundable. In particular, no refund is owed if your account is suspended or terminated for violating these terms (see Termination below).

We may change membership prices from time to time. Price changes do not affect the period you have already paid for: they apply starting with your next renewal, and we will notify you in advance so you can cancel before the new price takes effect.

Intellectual property

The Service, including its software, design, and the organization of its database, is owned by Kramer Software or its licensors. These terms do not grant you any right to use our name, branding, or content outside the Service.

Copyright complaints

If you believe content on the Service infringes your copyright, email support@beercantracker.com with: identification of the copyrighted work; the location of the allegedly infringing content on the Service; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will review complaints and remove infringing content, and we may close the accounts of repeat infringers.

Changes to the Service and availability

We are always working on the Service and may add, change, or remove features, or suspend or discontinue the Service in whole or in part, at any time. We do not guarantee that the Service, or any content or data stored in it, will always be available, and we are not liable for any modification, suspension, or discontinuation. We take reasonable care with the data you store, but we do not guarantee backups: keep your own copies of anything you cannot afford to lose. If we permanently discontinue paid membership features, we will refund the prepaid, unused portion of your membership.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, reliability, availability, or fitness for a particular purpose. The database includes information contributed by users and collected from public sources, and we do not warrant that it is accurate or complete.

Limitation of liability

To the fullest extent permitted by law, Kramer Software will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim, or $50 if you have paid nothing.

Indemnification

You agree to indemnify and hold harmless Kramer Software and its officers, employees, and agents from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from content you submit, your use of the Service, or your violation of these terms or of anyone else's rights.

Termination

You can stop using the Service or ask us to delete your account at any time. We may suspend or end access to the Service, or any part of it, for violations of these terms or to protect the Service. If we suspend or terminate your account because you violated these terms, you are not entitled to a refund of any membership fees, in whole or in part, including for any unused portion of your membership period.

App store terms

If you use a BeerCanTracker app downloaded from the Apple App Store or Google Play, these terms are between you and Kramer Software only, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the apps or their content, and have no obligation to provide maintenance or support for them or to address any claims relating to them, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with the terms of service of the app store you downloaded the app from.

Changes to these terms

We may update these terms from time to time. We will update the date above, and for significant changes we will note it on the site. Continued use of the Service after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Missouri, without regard to conflict of law rules. Any dispute that is not subject to arbitration under the section below will be brought exclusively in the state or federal courts located in Missouri, and you consent to the jurisdiction of those courts.

Dispute resolution and arbitration

Before filing a claim against us, you agree to try to resolve the dispute informally by emailing support@beercantracker.com and giving us 30 days to respond. If we cannot resolve the dispute informally, any dispute arising out of these terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court. Arbitration will be conducted in English, remotely or in the county where you live.

You and Kramer Software each waive the right to a jury trial and the right to participate in a class action: disputes may be brought only on an individual basis. If the class action waiver is found unenforceable for a particular claim, that claim, and only that claim, must proceed in court instead.

You may opt out of this arbitration agreement by emailing support@beercantracker.com within 30 days of first accepting these terms, with your account email and a statement that you are opting out of arbitration. Opting out does not affect any other part of these terms.

Except where prohibited by law, any claim arising out of these terms or the Service must be filed within one year after the claim arises, or it is permanently barred.

General

These terms, together with our Privacy Policy, are the entire agreement between you and Kramer Software about the Service. If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a provision, that is not a waiver of our right to enforce it later. We may assign these terms, for example in connection with a merger or sale of the business; you may not assign them. Sections that by their nature should survive termination, including Content and data, Disclaimers, Limitation of liability, Indemnification, and Dispute resolution and arbitration, survive.
